Submission:Intelligence and Security’s Review of the effectiveness of the Telecommunications Legislation Amendment IPO Bill 2020

Allens Hub member Genna Churches, UNSW Law student Michael Murdocca, Hub Stream Lead Monika Zalnieriute and Hub Director Lyria Bennett Moses prepared a submission for the Parliamentary Joint Committee on Intelligence and Security’s Review of the effectiveness of the Telecommunications Legislation Amendment (International Production Orders) Bill 2020 (‘IPO Bill’).  This Bill amends existing telecommunications access laws, in preparation for a CLOUD Act Agreement with the US.  The IPO Bill and a resulting agreement would allow Australian law enforcement agency access to telecommunications, data and telecommunications data held in the US under a warrant process.

The Allens Hub Submission covers important issues, particularly surrounding complexity, language and ambiguity, and a failure to protect the right to privacy.
