Submission: NSW Mandatory Reporting Scheme for Data Breaches

Allens Hub researchers Genna Churches, Dr Monika Zalnieriute and Professor Graham Greenleaf prepared a submission to the New South Wales Inquiry into Adopting a Mandatory Reporting Scheme for Data Breaches. 

This submission touched upon a number of areas of law crucial to determining the need for a mandatory reporting scheme and how that scheme should operate. 

The researchers considered existing New South Wales privacy and data handling legislation in light of Commonwealth level protections for data breaches and recommended that New South Wales adopt a strong mandatory reporting scheme for data breaches based primarily on the standards set in the EU’s General Protection Data Regulation.  They highlighted existing support for a New South Wales scheme and urged the inquiry to implement a mandatory reporting data breach scheme to protect the data/information of residents of New South Wales.
