The courts and the pandemic: the role and limits of technology

The FLIP Stream annual topic for 2020 includes an examination of online courts. The topic has proved a prescient choice with the COVID-19 pandemic and the related public health restrictions such as physical distancing resulting in courts expanding their use of technology, including through remote hearings. 

The first publication on the topic is “The courts and the pandemic: the role and limits of technology” by Professor Michael Legg and Anthony Song in the May issue of the Law Society Journal.  The article consider how the courts’ use of technology is able to maintain the essential values of open justice and procedural fairness.  Find a copy of the article here
